Trip Planning Information

THE WHITSUNDAY
Lying in the tropics, close to 20º South and cooled by the trade winds for most of the year, the Whitsundays have an excellent climate. The waters are protected by the Coral Sea and Great Barrier Reef and most islands are surrounded by a fringing reef system. Seasons tend to be dictated by school holidays rather than weather, so some of the best sailing can be found in the off-peak periods. Summers are warm with frequent rain showers and winters are said by many to be the perfect climate - warm by day and cool by night. The trade winds usually blow slightly stronger from May to August. July is the coolest time, January the warmest. And cyclones, if they do occur, are most likely between February and March. Good anchorages are plentiful and varied.

THE ANCHORAGE
The Whitsundays have enough anchorages to keep you busy for months of happy cruising! So you can include some on your itinerary, here are a few of the Operator's favourites with recommended snorkelling sites either at your anchorage or just a short dinghy ride away. The seven resort islands in the Whitsunday also welcome visiting yachts. A reasonable fee includes a mooring or marina berth and the freedom to enjoy the guest facilities of the resort. Each island resort's ambience and facilities is different and that means more variety for you!

SUGGESTED ITINERARY

Arrival day:
Area and boat briefing in the marina. Lunchtime departure for Nara Inlet. Explore waterfalls, Aboriginal caves and ancient rock paintings. Or just relax with a glass of champagne.

Day 2:
Sail across the Whitsunday Passage, anchoring later in Cid Harbour or Gulnare Inlet. Quiet and peaceful with wonderful wildlife, bush walks and delicious rock oysters.

Day 3:
Set sail for spectacular Whitehaven Beach and enjoy miles of soft, white silica sand beaches. Swim, windsurf and relax.

Day 4:
Cruise over to Hamilton Island for fresh supplies or to top up water tanks. Experience a change of pace in the busy marina and a choice of restaurants and bars.

Day 5:
With the tradewinds on your beam, reach up to Cataran Bay on Border Island for great snorkeling.

Day 6:
For more exploring, a short sail takes you across to Butterfly Bay on Hook Island. Use the dinghy for more snorkeling or onshore visits.

Day 7:
Take a leisurely cruise around the Hayman Island area or southwards across the Whitsunday Passage to South Molle Island or Palm Bay to celebrate the last night of a great cruise!

Day 8:
Sail back to the supplier base for your boat check in.

Whale Season
Humpback whales are throughout the Whitsundays in these months, many with newborn calves. Listen for their songs while snorkelling and be on the watch for their spouts and breaching when sailing. Don't be surprised if they even come into the anchorage, especially around the northern islands. You could watch a display right at the back of your boat like this photo - this mother and calf photo was taken in Blue Pearl Bay.

For those in the know, fishing around the Whitsundays can be very fruitful. For those not so knowledgeable, it can simply be fun to drop a line & see what happens. What type of fish can you expect to catch in the Whitsundays?
Bluefin and Mackeral are in abundance all year round. They can usually be located by the sight of seabirds skipping over the surface of the water where the tuna are. Casting or trolling around the headlands and in the passages between the islands should also land you a few good tuna for dinner.

There is excellent estuary fishing to be found in Gulnare inlet, Hill inlet, Nara and Macona inlets.

Coral Reef Fishing can provide the likes of Coral Trout, Sweetlip, Emporers, Gropers etc.

Before visiting the Great Barrier Reef Marine Park, it is important you study the zoning map for the area you are visiting to be sure of the activities that you can do and where you can do them. A link to the zoning map is below:

Why do we
have closed seasons?
Closed seasons prevent people from fishing at certain times of the year to protect species at vulnerable times in their life cycle, such as during spawning seasons.

Barramundi
Throughout the Queensland East Coast, a closed season applies to Barramundi from midday on the 1st November to midday 1st February.

There are 3 x nine day periods that have been implemented as closed seasons for the taking of all coral reef fish. These are October, November and December each year around the new moon phases. The closures apply to all Queensland East Coast waters between latitude 10°41´S and 24°50´S. The closures are designed to protect spawning aggregations of most Coral Reef Fish Species.

The closures for 2008 will be:
* 22 October 2008 to 30 October 2008 (inclusive)
* 21 November 2008 to 29 November 2008 (inclusive)
* 21 December 2008 to 29 December 2008 (inclusive).

GOOD NEWS ON STINGERS
Queensland Surf Lifesaving has released the latest data on stingers (jellyfish) and the news is all good! There has been a 75% reduction in serious stings since 2002, with only 10 in Tropical North Queensland in 2004-2005!
With the hundreds of thousands of people holidaying and swimming here over the summer months, this clearly shows that the precautions being taken are working and that there is really no reason to miss out on snorkeling and diving in wonderful warm, clear tropical waters over these months.

HOW TO GET TO THE BASE:
This vessel is situated in Abel Point Marina, Airlie Beach, easily accessible via Proserpine (Whitsunday Coast) airport and Hamilton Island. Proserpine (Whitsunday Coast) airport is recommended as the most convenient airport. It is recommended you arrive the day prior to your charter and overnight in Airlie Beach or take the half price Sleepaboard option on your vessel. We can arrange transfers to your base or your accommodation in Airlie Beach - please advise us if this is required. The travelling time is approximately 45 minutes.

The ideal is to start your briefing early on the first day of charter with an aim to having you on the water by lunchtime. If driving, there is free parking in the public car park. Alternatively, the marina car park has semi secure parking and lock up secure storage is available.

For a relocation fee, the vessel can also be delivered to Hamilton Island so that you may start and finish your charter from there or you can catch a Resort Connections ferry straight from the airport marina to Abel Point Marina.

INTERNET CONNECTIONS
Wireless internet access on board your boat is offered in Abel Pt Marina and Hamilton Island Marina. You will need to log onto Marinanet and sign in for the package you need.

MOBILE PHONE COVERAGE
Coverage is limited in the islands. On the outside (eastern sides) of the islands there is no coverage. Inside the islands and from some northern anchorages there is some coverage.

BASE OPERATING HOURS:
8am to 5pm weekdays
9am to 4pm weekends
Closed Christmas Day and New Years Day

CHARTER START/FINISH:
Your charter can start and finish on any day of the week except Christmas Day, New Year's Day and Fun Race Day. Check-ins and briefings are at 9.00am unless you have a sleep aboard when the check-in is 4.00 pm. Boats must be returned by 10.00am. If you want to return later than 10am, it cannot be confirmed until the day before your charter ends. This is done via VHF radio.

Usually there isn't a charge if you want to return at 12pm, but if you remain out until 4:00pm then you may be charged an extra $200-$400 depending on size of vessels, etc. An extensive briefing follows check-in, taking in navigation, anchoring, safety and practical boat handling. On board you will find charts, navigation aids and cruising guide "100 Magic Miles of the Great Barrier Reef" by David Colfelt.

HALF PRICE SLEEPABOARD
Arriving lunchtime or late in the day? Then take advantage of the Half Price Sleepaboard option. Boarding time is 4pm (or earlier if available) with a quick boat brief taking place at this time, followed by the full briefing the following day.

EXPERIENCE:
Some basic boating experience is essential for your boating holiday. If you do not have a reasonable level, the it is recommended you try and gain some experience through friends or a Learn to Sail course. Alternatively, a Sailguide can be placed onboard your vessel for a day or two or even a half day.

SAFETY/LIFE JACKETS/STINGER SUITS:
The charter boat meets all safety requirements and has undergone an extensive check before you board. You'll have a ship-to-shore radio on board and will be in regular contact with base for daily check-ins, weather reports and for any local advice.

It is recommended stinger suits be worn during the jellyfish season which generally runs from October to May. The thin lycra suits do not need to be pre-booked and are available for hire on arrival at $20.00 per suit . Also available for purchase full length ultra thin suits at $35.00 per suit and in the cooler months have available steamer suits (also for hire) which offer sun protection and extra warmth.

Please note that children's lifejackets are not supplied as the Queensland Department of Transport does not recognise approved lifejackets for any young children in your group. If you require children's lifejackets they can be hired from the Dive Shop at the marina.

WHAT YOU'LL FIND ON BOARD:
All linens, towels, blankets, pillows, well equipped galley with refrigeration, hot and cold water, deck shower, snorkelling equipment, electric anchor winch, deck BBQ, cruising guide, navigation equipment, safety gear, wet weather jackets, CD player, toilets and showers, inflatable dinghy with outboard.
Note: Fishing gear is not supplied on board.

INCLUSIONS:
Your boating holiday is fully inclusive in the price except for fuel which is a simple "pay as used" basis and applies to all sail and motor boats. You can expect to pay around $80.00 to $120.00 per day for motor boats & around $20.00 per day for yachts. Dinghies include one full tank of fuel.

SNORKELLING, FISHING & SCUBA DIVING:
The Whitsundays form part of the Great Barrier Reef Marine Park. Excellent snorkelling and fishing sites are found throughout the islands. Although fishing equipment is not included in your charter rate, fishing is permitted in appropriately zoned areas. Gear can be hired from Airlie Bait & Tackle. Spear guns are not encouraged. Quality snorkelling gear is included on board. Certified divers can hire equipment prior to arrival.

PRE-CHARTER KIT:
You will be issued with a pre-charter kit with an island chart, area information and comprehensive operations manual upon confirmation.

SECURITY BOND:
A security bond is required when you pick up the boat. Credit card details are taken to cover against unpaid incidentals such as Marina berth fees that may not have been paid for or any fuel charges (if it is unable to get them on the fuel dock at end of charter). Credit Card details are not used for any damage to the vessel.

BALANCE OF FEES:
Is due upon confirmation. The Operator do recommend purchasing a copy of the 100 Magic Miles of The Great Barrier Reef to assist you in planning your holiday.

RESTRICTIONS:
- Sundecker 36, Seawind 1000 premium, Bavaria 37, Delphia 40 can not be opearted from Bowen to Mackay.
- Pets are not allowed on the boats
- Smoking is not allowed inside of boats.

Rental Terms for travel between 01-Apr-2008 and 31-Mar-2011

On arrival you will be required to sign a rental agreement. Here is a summary of the terms and conditions:

1. Interpretation
The Operator includes the owner of the Boat, the Operator's subsidiaries, employees, directors, affiliates, agents and subcontractors appointed by the Operator. The Charterer includes the Charterer's guests, family, employees, agents and crew members. In this agreement, unless the context otherwise requires, the singular includes the plural and vice versa, words denoting gender shall include all other gender, headings are for convenience of reference only and shall not affect construction of the agreement. Children are defined as persons under the age of sixteen years. Time is of the essence of this agreement.

2. Delivery
The Operator shall deliver the Boat at the Port of Delivery staunch, clean and in full commission ready for service at Midday of the commencement date. The Operator may allow credit pro rata for charter fees covering periods of delay in delivery. The Operator has the right, at its discretion, to substitute a boat of similar type or to cancel the charter and to refund the charter fee. If the Operator fails to make delivery within twenty-four hours after the due time then the Charterer may cancel the agreement and a full refund of the charter fee will be paid. The Operator shall then have no further liability to the Charterer beyond that refund. The Charterer warrants that he will examine the Boat before taking delivery and by accepting the Boat shall be deemed to have satisfied himself that the Boat is staunch and properly outfitted for a yacht or motor cruiser of her type, size and accommodation. Should the Charterer not be ready to accept delivery of the Boat at the stated time for delivery for any reason the Operator has the right to set the time of delivery any time within the next twenty-four hour period. In that event there shall be no partial refund for any of the charter time lost. The charter period commences with the area briefing and boat familiarisation or sail orientation.

3. Payment, Cancellation and Damage Waiver

3.1 The Charterer shall pay:
- A deposit on or before signing a hire agreement;
- The balance of the charter fee is required at the time of confirmation;
- A damage waiver; and
- A fuel bond if applicable.

3.2 In the event the Charterer cancels this agreement, it must be made in writing to bookings@boatreservations.net. Please note a booking is not cancelled until you have received an email notice/acknowledgement of your cancellation.

There is a 25% deposit required at the time of booking which 15% of the charter amount is non-refundable. In addition to this, the following charges also apply:
A $110 administration fee is applicable if the charter is cancelled more than 63 days prior to departure and this will be taken from the deposit with the remainder refunded.
If less than sixty three days of notice of cancellation is given the full charter fee shall remain due and payable and will not be waived or refunded unless the Operator is able to obtain an alternative booking for the same charter period.

3.3 The Charterer shall pay a non-refundable damage waiver payment as set out in this agreement per insurable incident. That amount shall be retained by the operator and applied against minor loss and damaged items on the vessel up to a maximum of $550.00 being the insurance excess where that loss or damage is not:-

Damage Waiver Insurance
- $180, $300, $400  depending on the vessel size plus a refundable bond of $500.00. This is refunded within 7 days completion of charter

- $650 Compulsory Damage Waiver Insurance plus $500 bond for the Fontaine Pajot 46 Power Cat. There is also a fuel bond of $2000 for the Fontaine Pajot 46 Power Cat.

3.3.1 In the reasonable opinion of the Operator due to the negligence of, or incurred by the malicious or willful acts of the charterer or its party:
3.3.2 Relating to the rigging
3.3.3 The loss of the dinghy & outboard
3.3.4 Stuck Anchors
3.3.5 Prop wraps caused by sheets, moorings, anchor rope, dock lines, dinghy painters, halyards, floating rope & the removal there of
3.3.6 Chase calls due to charterer
3.4 The damage waiver payment in Clause 3.3 in no way limits or reduces the Charterer's liability in respect of the agreement other than so as to reduce the minor loss or damage items referred to in that clause.

4. Inventory
At the time of delivery the Charterer shall, if requested by the Operator, complete, check and sign a record of inventory and on redelivery to attend to checking with the Operator and to countersign the record of inventory after checking. Any lost or damaged inventory item shall have all expenses relating to the loss or damage paid by the charterer. If the Operator does not require signing of a record of inventory, its right to be paid by the Charterer is not waived.

5. Running Expenses

The Charterer shall pay all running expenses during the charter period including pilotage, port charges, sail guide and crew charges, service calls (excluding break downs not the fault of the charterer), refuelling costs, engine running costs (if applicable) and provisions and supplies for the charterers party. If the Charterer is chartering a motor cruiser the charterer agrees to pay a fuel deposit as determined by the Operator.

6. Competency

In this clause "competent person" means a person competent in the handling of the type of boat chartered including:
- Knowledge and practical experience of seamanship; and
- Knowledge and practical experience in the handling of inboard auxiliary powered sailing craft and associated equipment of the general type and size of boat.

(a) The Charterer warrants that he is a competent person in the handling and operations of the type of boat chartered.
(b) The Charterer undertakes not to permit any other person to operate the Boat unless that person is a competent person.
(c) The Operator reserves the right to require the Charterer and any other person who shall operate the Boat to demonstrate to the Operator that they are competent persons. Should the Operator not be satisfied with the competency of the Charterer, the Operator may require a sailing guide on board the Boat for such period as determined by the Operator.
(d) In the event that the Charterer or any other person is considered by the Operator to be a competent person as a result of any misleading, deceptive conduct or misrepresentation by the Charterer and upon which the Operator has relied to form an opinion then the Operator shall have the right to install a competent sailing guide aboard the Boat and at its election to terminate this agreement. The Operator shall have the right to recover all losses against the Charterer without any liability to refund or compensate the Charterer.

7. Navigation and Other Limits
The Charterer shall restrict the cruising of the Boat from 0630 to 1700 hours unless authorised by the Operator. The Charterer shall limit his cruising perimeter to the area and limitations clearly defined and specified by the Operator. The Boat shall be employed exclusively as a pleasure boat for the sole and proper use of members of the Charterer's party. The Charterer shall not carry on the Boat more than the specified number in the party and the Charterer shall not permit any other party, except competent persons within the Charterer's party, to operate the Boat unless the prior written permission of the Operator is obtained. The Charterer shall not race the Boat. The Charterer shall not raft up the Boat up against any other vessel. Except with authorisation of the Operator the Boat must not be used for towing any vessel other than the tender. There must be no transferring of any equipment from the Boat. The Charterer shall not engage in trade including transporting merchandise or passengers for pay. No goods, documents or drugs shall be carried which would involve the risk of seizure of the Boat by any government. Pets shall not be taken on the Boat. Children must be under the control of a responsible adult. That adult is responsible for the conduct and personal safety of the children while on the Boat. The Charterer shall not allow any person on board to commit any act contrary to the laws of Australia, or of any other government within the jurisdiction of which the Boat may be at any time and shall comply with the law in all other respects. The Charterer shall not tie the Boat up at any jetties or piers except those approved by the Operator prior to the charter or make any landing with the Boat.

8. Charterer's Authority
At the commencement of the charter period the Operator shall relinquish its possession and command of the Boat to the Charterer and full authority regarding the management of the Boat and its crew or members of the charter party shall be transferred to the Charterer for the period of this charter. Should a sailing guide be put on board either at the Charterer's request or at the Operator's option the sailing guide shall be under the sole direction and control of the charterer who shall be fully responsible for the sailing guide. The Charterer shall pay the Operator for the sailing guide at the current daily rate listed at the Operator's offices and feed and accommodate the sailing guide. If a sailing guide is put on the Boat, then although the Charterer shall have possession, command, navigation and full control over the Boat, the sailing guide is to be sole judge as to whether it is reasonable or prudent to sail at any time and as to whether any specified anchorage is reasonably safe.

9. Redelivery

The Charterer shall redeliver the Boat to the Operator free from any indebtedness which may have occurred on the Charterer's account at the Port of Return together with all of its equipment, in the same good condition as it was at delivery, save for fair wear and tear from ordinary and proper use. If for any reason other than that the Boat has become a total loss, he shall fail to redeliver the Boat at the agreed place and time, he shall pay the Operator demurrage at the rate of the charter fee per night of the Boat plus 50% for every day or part of a day ("Agreed Demurrage") until redelivery is effected. If the Charterer leaves the Boat at any place other than the Port of Return he shall pay to the Operator: all expenses involved in transferring the Boat to the Port of Return; Agreed Demurrage for the number of days required for the transfer; plus any losses or damage not covered by the Operator's insurance which may occur on or to the Boat or otherwise arises from the redelivery until it has been redelivered to the Charterer at the Port of Return. In the event the Charterer should elect for any reason to redeliver the Boat prior to the end of the charter period the Operator shall not be liable to return any part of the charter fees.

10. Cleaning
If upon completion of the charter the Charterer has not left the Boat in clean and tidy condition then the Charterer shall pay for the costs of cleaning the Boat.

11. Recall

The operator reserves the right to recall the Boat at any time if the weather is considered by the Operator to be a threat to safe operation or in the Operator's opinion the Boat is being improperly or incorrectly sailed, managed or controlled so as to imperil the Boat, other vessels or property or life. A recall may include but is not limited to a recall to the Operator's base or an instruction to proceed to a haven deemed to be safe for the prevailing conditions. During a recall the Charterer may be required to vacate the Boat depending on conditions. The Operator shall not be liable for any lost time, expense or losses to personal goods or property due to recall and the Operator is not liable to repay any charter fees.

The Charterer is advised to take out the appropriate insurance cover for such events.

12. Service Calls

In the event of a malfunction of the Boat or its equipment, the Operator shall subject to prevailing weather conditions use its best endeavours to reach the Boat with a service call at the earliest opportunity. In the event a service call is not in the Operator's opinion reasonably possible, or if the problem cannot be otherwise rectified, the Charterer shall proceed to the point designated by the Operator where repairs or replacement, where possible, will be made. If the service call is in the reasonable opinion of the operator due to any fault of any member of the charter party any cost incurred shall be at the expense of the charterer.

13. Replacement

In the event that a fault in the Boat is detected before or during the charter period that may cause unsatisfactory performance of the Boat or equipment, then the Operator has the right to expeditiously effect repairs. In the event the Boat is in the Operator's opinion inoperable during part of the charter period through no fault of the Charterer rendering total or premature termination of the charter, the Operator may at its option endeavour to provide as a substitute an alternative boat of similar size and quality for the charter period. If no substitute boat can be provided the Charterer shall be entitled to a reimbursement, limited to the charter fees for each full day of the charter which has not been used.

14. Accident or Breakdown
In the event of any accident, loss, breakdown or disaster, the Charterer shall give immediate notice to the Operator and shall not except to the extent necessary to minimise a loss of the Boat, authorise or undertake repairs without prior authorisation of the Operator. The Charterer shall be responsible for the costs and consequence of any unauthorised repairs. The Charterer shall make no admission of liability to any party and no refund shall be made in respect of any claim arising out of such accident, loss, breakdown or disaster, save as is otherwise provided in this agreement. The Operator at its discretion shall determine if the cost of any repair, service (including cost for service vessels), breakdowns, recall or repossession or any other costs incurred by the Operator are chargeable to the Charterer and if so shall be owing and paid by the Charterer.

15. Limitation of Liability
To the extent permitted by law, the liability of the Operator for indirect, special or consequential damages in connection with or arising out of the services under this agreement shall be limited to the supply of those services. The Operator shall not be liable for any other indirect, special or consequential damages.

16. Alcohol and Drugs

The use or consumption of illegal drugs by anyone using the Operator's facilities, property or boats, either ashore or afloat is prohibited. The consumption of alcohol may increase the risk of injury around docks, water and boats and the Charterer accepts that risk. The Operator shall not be liable for any personal injury or death arising from or in any way related to the use or consumption of alcohol or illegal drugs.

17. Personal Losses

The Operator shall not be liable for loss of personal property and goods of the Charterer whilst on the Operator's property or boats.

18. Insurance

The Boat chartered is customarily insured for the charter period as protection against any accidental loss or damage that may occur, or be caused by, the Boat during the charter period so long as the Boat remains in the cruising limits and perimeters established in clause 7 and is operated in compliance in all the terms and conditions of this agreement. Any excesses in connection with claims made under the policy may be debited by the Operator against the Charterer. In case of loss, accident breakdown, or a disaster, the Charterer shall give immediate notice to the Operator and shall not except to the extent necessary to avert or minimise damage or a loss of the Boat, attempt repairs without authorisation of the Operator.

19. Insurance Limitations

The insurance cover on the Boat does not usually cover Charterer negligence. The Charterer is liable for all damages or loss caused by him or other members of the charter party arising through his or any of the Charterer's party's negligence or incurred by malicious or willful acts of the Charterer or members of the Charterer's party. The Charterer's liability extends to the Operator and other parties to the full cost of making good any loss or damage. The damage waiver payment in clause 3 in no way reduces the Charterer's party's liability arising from negligence or incurred by malicious or willful acts. The Operator recommends that the Charterer effect Charterer negligence insurance and appropriate travel insurance.

20. Indemnity

The Charterer shall indemnify, reimburse and hold the Operator harmless from and against any acts and all claims, losses, liabilities, demands, suits, judgement or causes or actions and all legal proceedings whether civil or criminal, penalties, fines and other sanctions and any other costs and expenses in connection which may result from, or arise in any manner out of any matter related to this charter agreement or arise out of the management, control, encumbering use or operation of the Boat by the Charterer. No claim of any nature shall be brought against the Operator by the Charterer or any of the charter party and the Charterer agrees that he shall indemnify the Operator in respect of any amount paid by the Operator in respect of any such claim.

21. Damage

If the charterer damages the vessel to the extent the charter cannot continue, the owner is not liable to pay any refunds, compensation or replace the vessel with another. The charterer may take out insurance to cover this event.

22. Inoperable Boat

In the event that in the reasonable opinion of the Operator the Boat becomes inoperable during the Charter Period through action or inaction of the Charterer or any of his party the operator may at its option terminate this agreement and retain all charter fees paid. The Operator may then at its option offer a further charter to the Charterer on another vessel. The Charterer shall if he accepts the offer then pay another damage waiver and all costs of a further charter including the charter fee.

23. Water Sports
The Operator and its insurance underwriters shall not be liable for accidents, injuries or death due to: swimming; windsurfing; the use of the Boat's dingy and outboard engine; or the use of snorkels, masks, fins or scuba equipment whether supplied by the Operator or otherwise. The user of the equipment referred to in this clause must ascertain that they are experienced, qualified and capable of using the equipment and the equipment is suitable and in good condition for the purpose for which it will be used and for the person using it.

24. Radio Arrangements

The Charterer agrees to contact the Operator's base on or within such time as the Operator may at its discretion stipulate to the Charterer including each morning and afternoon on each day of the charter period and furnish necessary details of the Boat's position, intended plans for the day and intended anchorage position for that evening. In the event that the Charterer fails to so notify and contact the Operator's base on any two consecutive schedule periods, then that Charterer shall be responsible for all costs or expenses incurred by the Operator in searching for the Charterer including but not limited to, the hire of aircraft or other means of transport.

25. Government Fees and Future Taxes

Charterers pay a fee per person (over the age of 4 years) on arrival in cash for costs of the use of the Great Barrier Reef Marine Park. The Charterer shall also pay and discharge without exception all taxes, charges, assessments and outgoings and impositions relating to the charter imposed by or under federal or state law, or by federal, state or local authorities and whether on a capital or revenue basis or any other basis and even though of a novel character which may at any time be introduced during the period from execution of this agreement to the end of the charter period.

26. Non-Assignment

The Charterer shall not assign or sub-charter his interest in the Boat without the prior written consent of the Operator. The Operator may assign its rights under this agreement.

27. Applicable Law

This agreement shall be governed by the laws of the State of Queensland and the Commonwealth of Australia and any dispute arising or relating to the agreement or the charter shall be referred to the courts of Queensland and be heard at the nearest relevant court, being the Magistrates Court at Proserpine, the District Court at Bowen or the Supreme Court at Mackay.

Good News On Stingers
Queensland Surf Lifesaving has released the latest data on stingers (jellyfish) and the news is all good! There has been a 75% reduction in serious stings since 2002, with only 10 in Tropical North Queensland in 2004-2005!

With the hundreds of thousands of people holidaying and swimming here over the summer months, this clearly shows that the precautions being taken are working and that there is really no reason to miss out on snorkelling and diving in wonderful warm, clear tropical waters over these months.

How To Get To The Supplier:
The Operator are situated in Abel Point Marina, Airlie Beach, easily accessible via Proserpine (Whitsunday Coast) airport and Hamilton Island. Proserpine (Whitsunday Coast) airport is recommended as the most convenient airport. The Operator recommend you arrive the day prior to your charter and overnight in Airlie Beach or take the half price Sleep aboard option on your vessel. The Operator can arrange transfers to their base or your accommodation in Airlie Beach. The travelling time is approximately 45 minutes. The Operator recommends to start your briefing early on the first day of charter with an aim to having you on the water by lunchtime. If driving, the Operator offer free parking in the public car park. Alternatively, the marina car park has semi secure parking from $7.50 per day or lock up secure storage is available from $82.50 for a 5 night booking.

The Operator can deliver the vessel to Hamilton Island so that you may start and finish your charter from there or you can catch a Resort Connections ferry straight from the airport marina to Abel Point Marina (The supplier Base).

Internet Connections
The supplier can now offer you wireless internet access on board your boat in Abel Pt Marina and Hamilton Island Marina. You will need to log onto Marinanet and sign in for the package you need.

Mobile Phone Coverage
Coverage is limited in the islands. On the outside (eastern sides) of the islands there is no coverage. Inside the islands and from some northern anchorages there is some coverage.

The Operator are closed on Christmas Day and New Years Day

Charters Start/Finish:
Your charter can start and finish on any day of the week except Christmas Day, New Years Day and Fun Race Day. Check-ins and briefings are at 9.00am unless you have a sleep aboard when the check-in is 4.00 pm. Boats must be returned by 10.00am. If you want to return later than 10am, it cannot be confirmed until the day before your charter ends. This is done via VHF radio. Usually the Operator doesn't charge if you want to return at 12pm, but if you remain out until 4:00pm then the Operator may charge an extra $200-$400 depending on size of vessels, etc. An extensive briefing follows check-in, taking in navigation, anchoring, safety and practical boat handling. On board you will find charts, navigation aids and cruising guide "100 Magic Miles of the Great Barrier Reef" by David Colfelt.

Half Price Sleep aboard
Arriving lunchtime or late in the day? Then take advantage of the Operator's Half Price Sleep aboard option. Boarding time is 4pm (or earlier if available) with a quick boat brief taking place at this time, followed by the full briefing the following day.

Experience
Some basic boating experience is essential for your boating holiday. If you do not have a reasonable level, the Operator recommends you try and gain some experience through friends or a Learn to Sail course. Alternatively, the Operator can always place a Sailguide onboard your vessel for a day or two from $145.00 for a half day.

Safety/Life Jackets/Stinger Suits:
The supplier charter boat meets all safety requirements and has undergone an extensive check before you board. You'll have a ship-to-shore radio on board and will be in regular contact with base for daily check-ins, weather reports and for any local advice the Operator can provide.

The supplier recommend stinger suits be worn during the jellyfish season which generally runs from October to May. The thin Lycra suits do not need to be pre-booked and are available for hire at the Operator's base for $20.00 per suit . The Operator also has available for purchase full length ultra thin suits at $35.00 per suit and in the cooler months have available steamer suits (also for hire) which offer sun protection and extra warmth.

Please note that the supplier does not provide children's life jackets as the Queensland Department of Transport does not recognise approved life jackets for any young children in your group. If you require children's life jackets, the Operator recommends they be hired from the Dive Shop at the marina.

What You'll Find On Board:
All linens, towels, blankets, pillows, well equipped galley with refrigeration, hot and cold water, deck shower, snorkelling equipment, electric anchor winch, deck BBQ, cruising guide, navigation equipment, safety gear, wet weather jackets, CD player, toilets and showers, inflatable dinghy with outboard.
Note: Fishing gear is not supplied on board.

Inclusions:
Your boating holiday is fully inclusive in the price except for fuel which is a simple "pay as used" basis and applies to all sail and motor boats. You can expect to pay around $80.00 to $120.00 per day for motor boats & around $20.00 per day for yachts. Dinghies include one full tank of fuel.

Snorkelling, Fishing & Scuba Diving:
The Whitsundays form part of the Great Barrier Reef Marine Park. Excellent snorkelling and fishing sites are found throughout the islands. Although fishing equipment is not included in your charter rate, fishing is permitted in appropriately zoned areas. Gear can be hired from Airlie Bait & Tackle. Spear guns are not encouraged. Quality snorkelling gear is included on board. Certified divers can hire equipment prior to arrival.

Pre-Charter Kit:
The Operator will send you a pre-charter kit with island chart, area information and comprehensive operations manual upon confirmation.

Security Bond:
A security bond is required when you pick up the boat. Credit card details are taken to cover against unpaid incidentals such as Marina berth fees that may not have been paid for or any fuel charges (if the Operator are unable to get them on the fuel dock at end of charter). Credit Card details are not used for any damage to the vessel.

Balance of Fees:
Is due upon confirmation. The Operator does recommend purchasing a copy of the 100 Magic Miles of The Great Barrier Reef to assist you in planning your holiday.

Restrictions:
- Sundecker 36, Seawind 1000 premium, Bavaria 37, Delphia 40 can not be operated from Bowen to Mackay.
- Pets are not allowed on the boats
- Smoking is not allowed inside of boats.

Damage Waiver:
The Operator will request payment of a Damage Waiver ($160, $180 or $300 depending on size of vessel). This is non-refundable and covers minor loss and damaged items on the vessel per insurable incident. *Please refer to clause 3.3 and 3.4 in your Charter Agreement. Also payable on arrival is a Marine Park Fee (reef tax) of $20.00 per person per charter from 31 March 2007.

Insurance Information:
Your boat is fully insured for loss or damage, however the Operator recommends you consider taking out the following insurance to cover for other events:

Travel Insurance:
To cover you for the loss of pre-paid travel in the event of cancellation due to sickness, illness, accident, cyclone etc. The Operator does not offer refunds and strongly recommends you are covered by some form of travel insurance. Third Party Liability Insurance
This policy is designed to protect you from Claims made against you by others for Property Loss, Accidental Death, Bodily Injury or Illness to them caused by (or as a result of) your negligence. For this policy to apply to you, the hire vessel or its tender must be involved in the loss. Cover can be arranged on arrival at the Operator's base is $60 for a 5 night, 6 - 9 nights $115 and 10 or more $150 per charter.

Charter Negligence Insurance (Personal Liability)

 If you are involved in an accident:

  • Do not make any admission of liability

  • Contact Oceanic Insurance Brokers as soon as possible

  • Obtain Associated Marine Insurers written consent before incurring or agreeing to pay any legal costs or monies to third parties

  • Make a report to the Bareboat Operator 

Only Associated Marine Insurers have the right to settle or defend a claim against you by another party.
Sum insured $5,000,000 in the aggregate including legal costs (this means a total of $5,000,000 any one accident).

Your Policy
This policy is designed to protect you from claims made against you by others for property loss, accidental death, bodily injury or illness to them caused by (or as a result of ) your negligence. For this policy to apply to you, the hire vessel or its tender must be involved in the loss.

Associated Marine Insurers agree to indemnify the hirer/s, whose name/s are listed in the certificate, for any sums which he/she/they shall become legally liable to pay and shall pay, resulting from his/her/their negligence in the operation or use of the hired vessel named in the certificate and arising out of any accidents occurring during the currency of this insurance in respect of:

  1. Loss of or damage to any other vessel or property whatsoever.

  2. Accidental death, bodily injury or illness to any person not listed on the certificate herein.

  3. Any attempted or actual raising, removing or destroying of the wreck of any other vessel.

  4. Any failure to raise and remove the said wreck of any other vessel.

  5. Pollution arising from a sudden and accidental discharge of the hired vessel�s own fuel and/or lubricants but limited to $250,000 any one accident.

In conjunction with Clauses 1 to 5 and with their consent, Associated Marine Insurers will also pay:

  1. The legal costs incurred by the Hirer(s).

  2. The costs for the representation at any coroners inquest or fatal accident inquiry.

 This insurance does not cover any liability cost or expense arising from or as a result of:

  1. Death, bodily injury or illness of the hirers.

  2. Damage to any property belonging to the hirers.

  3. Any direct or indirect payment by the Hirer(s) under Workmen's Compensation or Employers Liability acts and any other statutory or common law liability in respect of accidents to or illness of workmen or other persons employed in any capacity whatsoever by the Hirer(s).

  4. Any person engaged in parasailing, water skiing, diving or land based activities not associated with the direct use of the vessel or its tender.

  5. Fines, penalties, punitive or exemplary damages however described.

  6. Breaches of Statutory Laws, By Laws or Regulations.

  7. Damage to the hired vessel caused by the Hirer/s.

  8. Pollution risks other than as provided for herein.

  9. War or warlike activity and acts of terrorism (war does not have to be declared).

  10. Hostilities, rebellion, insurrection or revolution.

  11. Anything nuclear or radioactive.

It is recommended that you choose a provisioning package through their providers, Whitsunday Provisioning. They will provide you with the freshest produce and top quality meats and all of this is stored away on board your vessel for your arrival.

You can choose between a package where 3 main meals are catered for along with snacks and nibbles or you can plan your own menu and choose your items from the self select list provided on the website. Should you wish to eat at some island resorts during your holiday, then perhaps a partial package should be considered where every third main meal is not catered for.

The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vessel. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking, you must complete our no-obligations reservations enquiry form which is easy to follow and secured with the latest encryption technology. Once we receive your enquiry, we will contact you via phone or email, to advise of availability and confirm the final price is correct - and discuss payment options. A booking is confirmed when you have been emailed a confirmation notice and at this stage the deposit is processed on your credit card and becomes non-refundable and any cancellation fees stated in the terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

Please note we accept Visa and Mastercard and the credit card fees are: 
1) 1.75% for the deposit amount.
2) 1.75% for the balance of payment.

If you are booking via phone, please first make sure you have read the terms and conditions of your selected sailing adventure. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental, trip or charter services.

Amendments
Please check the terms of each vessel to see whether amendment fees apply. Please also note that for some vessels an amendment is treated as a new booking and the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). In the case of boat rental/yacht charter, if the hire or number of days is increased, an additional deposit may be required, while reduction in rental periods or price may reduce the total, but the deposit amount will remain unchanged.

Vessel Capacity and fitness to charter (for Bareboats only)
Under no circumstances are you permitted to carry more passengers than the vessel you charter is legally registered to carry, and if you do your insurance may be invalidated. The number of passengers allowed is indicated next to each vessel on this website. It is your responsibility to choose a journey that is within your capabilities. A boat or trip supplier can refuse to hire a vessel to any person who is in their opinion unfit to skipper or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

The Charterer shall if he accepts the offer then pay another damage waiver and all costs of a further charter including the charter fee.

DAMAGE WAIVER:
Damage Waiver Insurance $180, $300, $400 (depending on vessel size) + refundable bond of $500.00 refunded within 7 days completion of charter - $650.00 waiver plus bond $2500.00 for the Fountaine Pajot 46 Power Cat.

Please note all Damage Waivers are non-refundable and clients are to leave a $500 fully refundable credit card bond on arrival.

OTHER INSURANCE INFORMATION:
Your boat is fully insured for loss or damage, however the Operator recommends you consider taking out the following insurance to cover for other events:

Travel Insurance
To cover you for the loss of pre-paid travel in the event of cancellation due to sickness, illness, accident, cyclone etc. The Operator does not offer refunds and strongly recommends you are covered by some form of travel insurance. Third Party Liability Insurance
This policy is designed to protect you from Claims made against you by others for Property Loss, Accidental Death, Bodily Injury or Illness to them caused by (or as a result of) your negligence. For this policy to apply to you, the hire vessel or its tender must be involved in the loss. Cover can be arranged on arrival at the Operator's base is $60 for a 5 night, 6 - 9 nights $115 and 10 or more $150 per charter.

Charter Negligence Insurance (Personal Liability)
 If you are involved in an accident:

  • Do not make any admission of liability
  • Contact Oceanic Insurance Brokers as soon as possible
  • Obtain Associated Marine Insurers written consent before incurring or agreeing to pay any legal costs or monies to third parties
  • Make a report to the Bareboat Operator 

Only Associated Marine Insurers have the right to settle or defend a claim against you by another party.
Sum insured $5,000,000 in the aggregate including legal costs (this means a total of $5,000,000 any one accident).

Your Policy
This policy is designed to protect you from claims made against you by others for property loss, accidental death, bodily injury or illness to them caused by (or as a result of ) your negligence. For this policy to apply to you, the hire vessel or its tender must be involved in the loss.

Associated Marine Insurers agree to indemnify the hirer/s, whose name/s are listed in the certificate, for any sums which he/she/they shall become legally liable to pay and shall pay, resulting from his/her/their negligence in the operation or use of the hired vessel named in the certificate and arising out of any accidents occurring during the currency of this insurance in respect of:

  1. Loss of or damage to any other vessel or property whatsoever.
  2. Accidental death, bodily injury or illness to any person not listed on the certificate herein.
  3. Any attempted or actual raising, removing or destroying of the wreck of any other vessel.
  4. Any failure to raise and remove the said wreck of any other vessel.
  5. Pollution arising from a sudden and accidental discharge of the hired vessel's own fuel and/or lubricants but limited to $250,000 any one accident.

In conjunction with Clauses 1 to 5 and with their consent, Associated Marine Insurers will also pay:

  1. The legal costs incurred by the Hirer(s).
  2. The costs for the representation at any coroners inquest or fatal accident inquiry.
This insurance does not cover any liability cost or expense arising from or as a result of:
  1. Death, bodily injury or illness of the hirers.
  2. Damage to any property belonging to the hirers.
  3. Any direct or indirect payment by the Hirer(s) under Workmen's Compensation or Employers Liability acts and any other statutory or common law liability in respect of accidents to or illness of workmen or other persons employed in any capacity whatsoever by the Hirer(s).
  4. Any person engaged in parasailing, water skiing, diving or land based activities not associated with the direct use of the vessel or its tender.
  5. Fines, penalties, punitive or exemplary damages however described.
  6. Breaches of Statutory Laws, By Laws or Regulations.
  7. Damage to the hired vessel caused by the Hirer/s.
  8. Pollution risks other than as provided for herein.
  9. War or warlike activity and acts of terrorism (war does not have to be declared).
  10. Hostilities, rebellion, insurrection or revolution.
  11. Anything nuclear or radioactive. 

This insurance is subject to Australian Law and Jurisdication
