Trip Planning Information

The charter base for this vessel is located on Hamilton Island - the heart of the Whitsundays and the gateway to the Great Barrier Reef. 

With its own jet airport, 10 cosmopolitan restaurants, an expansive range of resort and self-contained accommodation and a tonne of activities, Hamilton Island is Australia's largest and most popular island holiday destination.
A multitude of activities will keep you entertained before you set your sails, such as

A friendly representative greets every party upon arrival and transfers them to the base, so they can start their sailing holiday as soon as possible!
The charter base for this vessel is located in the Marina Village, just a short drive from the island's jet airport.
 
Upon arrival at either the airport or marina (if arriving by ferry), a representative will greet you and transfer you and your luggage to the supplier base. So don't forget to provide all of your arrival and departure details to the supplier team before your holiday! 
At the base, at least one member of your party will undergo a yacht charter briefing with staff member. This is an important opportunity to learn about the yacht and the local cruising area.
 
The base is very close to all of the conveniences in the Marina Village. There are shower/toilet facilities for guests, and the village also has a grocery store, National Australia Bank, post office, TAB, medical centre, bottle shop, bakery, souvenir store, newsagents and much more!

The Whitsundays are located just off the Queensland Coast of Australia with the closest mainland port being Shute Harbour.  the supplier Whitsundays is conveniently based on Hamilton Island which is located in the heart of the Whitsundays and is the perfect location to start your yacht charter holiday.

It has never been easier to get to the Whitsundays...
 
By Air
Hamilton Island is only a 1.5 hour direct flight from Brisbane, 2.5 hours from Sydney and 3.5 hours from Melbourne.
 
Fly Directly to Hamilton Island:
Jetstar, Qantas and Virgin Blue all offer direct flights to Hamilton Island's jet airport from most Australian capital cities.
 
Fly to to Proserpine Airport:
Fly Jetstar, Virgin or Qantas to Proserpine airport (Whitsunday Coast airport), which is located on the mainland. Proserpine is a 30 minute coach ride to Shute Harbour followed by a 40 minute ferry to Hamilton Island. Alternatively you can fly in a light aircraft from Proserpine airport to Hamilton Island airport.
 
Fly to Mackay Airport:
Fly Jetstar, Virgin or Qantas to Mackay airport which is also on the mainland. Mackay is a 120 minute coach ride to Shute Harbour followed by a 40 minute ferry to Hamilton Island. Alternatively you can fly in a light aircraft from Mackay airport to Hamilton Island airport.
 
By Road:
If you are driving or catching a coach to commence your Whitsunday sailing holiday, you need to drive to Shute Harbour which is located 10 minutes past Airlie Beach. On arrival to Shute Harbour you can lock your car up in the nearby security car parking facility and catch a ferry to Hamilton Island.
 
Airlie Beach (Abel Point Marina) starts:
For a delivery fee of $220 each way the Operator can deliver your yacht to Airlie Beach so you can commence your charter from the mainland, instead of Hamilton Island.

The book also details fishing guidelines and snorkelling spots plus has loads of information on the local area and individual destinations.
While this book will be onboard, we recommend you purchase and read the book prior to your charter.

FREQUENTLY ASKED QUESTIONS

WHAT QUALIFICATIONS DO I NEED TO CHARTER?
Experience is more important than paper qualifications. Although no formal qualifications are required to charter your own bareboat yacht, at least one of your crew members has previous sailing or yachting experience to level 3-4.

Two people on board with sailing experience are required. The skipper must have sailed this size yacht before for at least 5 days or more, and have good navigation skills and must know how to anchor the yacht. The 2nd adult must have sailing knowledge and they need to know what to do in an emergency such as a man over board situation.

If you are unsure that you have the right experience to charter a vessel. You can complete our sailing experience questionnaire and we will be able to advise you if you are ok to charter your selected vessel, or what additional experience you need to obtain before your desired departure date.

Level 1:
Handling a yacht under motor, basic wind awareness, mooring and anchoring skills and/or flotilla course at a Sailing School.

Level 2:
Handling a yacht under sail, reefing, reading a chart, line of sight navigation, competent at bows to and stern to mooring.

Level 3:
As above plus previous skipper experience on flotilla holiday or equivalent experience. You will need to be competent of handling a yacht in close quarters and picking up a mooring buoy in varying conditions. Passages are longer with more varied conditions and stronger winds.

Level 4:
More taxing sailing areas where extended coastal experience is beneficial. RYA Day Skipper or equivalent experience, you should be able to...

* call on navigation and pilotage skills
* know your position at any one time
Upon booking you will be asked to fill out a sailing resume outlining your sailing history. If you do not have enough experience or are a complete novice, the supplier’s experienced instructors can get you to a level where you are confident enough to handle your own yacht.

HOW CAN I LEARN TO SAIL?
If you don't have any sailing experience but wish to experience a bareboat charter holiday, why not enrol in a Sailing School course, which can have you sailing your own yacht in no time!

DO I NEED A PROFESSIONAL SKIPPER?
Of course you don't need to hire a skipper for your holiday, but choosing a crew to accompany you on your yacht charter holiday means you can sit back and totally relax.
The crew are chosen for their friendliness and professionalism, and are dedicated to making your holiday as enjoyable and relaxing as possible.
Book a skipper and hostess for a crewed yacht charter of complete indulgence, or create your own culinary delights and just have a skipper taking the helm of your supplier yacht so you can sit back and enjoy.

HOW SAFE IS BAREBOAT YACHTING?
To ensure your safety at all times during your sailing holiday, help is contactable 24 hours a day, seven days per week via VHF marine radio. Radio announcements ("scheds") are also run twice daily to inform you of the latest weather forecast and record each yacht’s daily movements and overnight anchorages. A reliable back-up service ensuresyou will not be alone in the unlikely event of an emergency, or if you simply need more supplies or provisions.

WHAT TIME DO I START MY YACHT CHARTER?
Contract start time is 12 noon on the first day of your sailing holiday, to provide enough time to fully prepare your yacht. If you are already at the base or wish to start your charter earlier, will endeavour to meet your requests. You will find out your briefing time any time from 8.30am on the day your charter commences.
Contract finish time on your last day is 10.00am. Late check-outs are available depending upon your vessel’s movements the following day. Late check-outs cannot be confirmed until the day before you finish your yacht charter. Again, special requests will always be given consideration.

WHAT DOES IT COST? ARE THERE ANY OTHER FEES?
You’ll be amazed at just how affordable it is to charter your own luxury yacht for the sailing holiday of a lifetime. As a general guide, a yacht charter usually equates to approximately $100 per person per night, depending on the size of vessel, number of people and length of stay.

SHOULD I TAKE OUT TRAVEL INSURANCE?
It is strongly recommended you cover your prepaid yacht charter fees against cancellation due to circumstances beyond your control. Ask us can about information on insurance policies available.

WHAT ABOUT FOOD AND BEVERAGES?
Careful provisioning is an important part of the preparation for your sailing holiday. By pre-arranging your provisioning, your vessel will be fully stocked with the type of catering you require prior to your arrival. Should you prefer to order specific provisions let us know and we'll do our best to help. Sailing can be very thirsty work. Your yacht can be stocked with a range of beer, wine, spirits and cold drinks so you will never run dry!

WHAT SHOULD I BRING?
Not very much! Each Supplier yacht is fully equipped for charter from every imaginable viewpoint. Apart from your personal possessions, you should bring your own...

  • beach towels
  • sunscreen
  • swimwear
  • polarised sunglasses (essential for seeing fringing reefs and can be purchased from the on arrival)
  • footwear – good solid footwear is advisable (an old pair of sneakers are ideal)
  • broad brimmed hat
  • light clothing that will provide protection from the sun and a tracksuit or warm clothing for the evenings
  • Soft luggage where possible

Rental Terms for travel between 01-Jan-2008 and 31-Dec-2010

These Booking Conditions apply to a reservation made with the Operators of this vessel, should therefore be read carefully. They contain some exclusions and limitations of liability. If any part of these Booking Conditions is found to be invalid or unenforceable, then the remainder of these Booking Conditions will not be affected and will remain valid and enforceable.

1. YOUR CONTRACT
Upon arrival you will be required to sign a rental agreement (contract) with the Operator. When making your booking, the person agreeing to the terms shown on this website (and repeated on the booking form) booking form (the “Party Leader’’) must have and is taken by the Operator to have the authority to do so on behalf of all the other people covered by the booking. Where “you” or “your” is used, this is the Party Leader and all people covered by the booking. By signing the form it means all people covered by the booking have read and accepted these Booking Conditions. The Party Leader will be responsible for the full cost of the charter, including any insurance premiums and cancellation or amendment charges and will also be responsible for any amounts for which you may be liable in relation to the charter. A contract exists as soon as you pay the booking deposit and by making that payment you will be deemed to have accepted the Operator's quotation invoice and agree to be bound by the Operator's booking conditions. This contract is made on the terms of these Booking Conditions which are governed by New South Wales Law and we both agree to submit to the jurisdiction of the New South Wales Courts at all times.

2. YOUR CHARTER PRICE
Once you have made your booking and paid your deposit, the cost of your charter will not normally be subject to any change. However, the Operator reserve the right to increase/surcharge or decrease prices, due to variations in service charges, security/insurance levies or fluctuations in exchange rates used to calculate the cost of
your charter. The balance of the price of your charter must be paid at least 10 weeks before your departure date or if it is booked less than 10 weeks before the departure date, upon making the booking. If the balance is not paid in time, the Operator may cancel your arrangements and retain your deposit. If you book through a travel agent, all contact with you will be via them. Money which you pay to the travel agent will be held by them on the Operator's behalf. In addition, if payment is late, clients paying their charter balance by credit card will be charged an additional 1% surcharge per month on the balance overdue. Contract start time is 1200 hrs on your first day of charter and disembarkation time is 1000 hrs on your last day of charter. If you return your vessel after 1000 hrs on your last day of charter you will be charged AUD$500 per hour for each hour after 1000 hrs.

3. IF YOU CHANGE YOUR BOOKING
If, after the Operator's confirmation invoice has been issued, you wish to change your arrangements in any way the Operator will do the utmost to make these changes, but it may not always be possible. Any request for changes to be made must be in writing signed by the Party Leader or your travel agent. You will be asked to pay an administration charge of $20 plus any further cost the Operator incur in making this alteration. Please check whether your holiday insurance will cover any changes or increased costs resulting from a change. Should you request a major alteration within 10 weeks of departure date (such as a change of date or area) then this will be treated as a cancellation and re-booking. Certain arrangements cannot be changed after a reservation has been made and any alteration will incur a 100% cancellation charge. Changes from a brochured charter booking to late availability or other special offers will not be permitted. Requests for changes to your booking should be sent to the Operator's Reservations Department or to your travel agent, if you booked with them.

4. IF YOU CANCEL YOUR CHARTER
You or any member of your party may cancel your arrangements at any time. Written notification of cancellation from the Party Leader or your travel agent on your behalf must be received at the Operator's offices on Hamilton Island referred to in paragraph 1. Cancellation will be effective on the date it is received by the supplier together with any travel documents already issued to you. The initial deposit paid is non-refundable. In addition to forfeiting your deposit, the following charges also apply:

5. IF THE OPERATOR CHANGE OR CANCEL YOUR CHARTER
It is sometimes inevitable that changes or cancellations may need to be made. The Operator reserve the right to make such changes should they become necessary. Most of these changes will be minor and the Operator will advise you or your travel agent of them at the earliest possible date. The Operator also reserve the right in any circumstances to cancel your travel arrangements. The Operator will not cancel your arrangements less than 15 days before your departure date, except for reasons of Force Majeure or failure by you to pay the final balance. If the Operator is unable to provide the booked travel arrangements and have had to cancel them before the charter is due to start, you can either:
• Accept the Operator's offer of a replacement charter of equivalent or higher quality (subject to availability).
• Accept the Operator's offer of a replacement charter of lower quality (subject to availability) and the Operator will refund the difference in cost.
• Accept a full refund of the money you have paid. No compensation will be paid nor a replacement charter offered
where the change or cancellation is due to Force Majeure. “Force Majeure” means unforeseeable and unusual circumstances
beyond the Operator's control. Such circumstances or events include (but are not limited to) war or threat of war, riot, civil strife, industrial dispute, unavoidable technical problems with transport, closure or congestion of airports, terrorist activity, natural or nuclear disaster, fire andadverse conditions.

6. CHARTER TERMINATION AND INDEMNITY
You must accept responsibility for the proper conduct of yourself and any members of your party. The Operator reserve the right in our absolute discretion to terminate without further notice the charter arrangements of any client who refuses to comply with the instructions or orders o the company staff, agent or other responsible person or whose behaviour or competence in the Operator's opinion is likely to cause distress, damage, danger or annoyance to their crew, other customers, staff any third party, any person or to property. Upon such termination the Operator's responsibility for your charter ceases and the Operator shall not be liable for any extra costs incurred by you.

7. IF YOU HAVE A COMPLAINT
If you have a problem during your charter, please inform a relevant member of the Operator's staff immediately, who will endeavour to put things right. If your complaint is not resolved locally, please follow this up within 28 days of your return home by writing to the Operator's Company Director at their address in paragraph 1, giving your booking reference and all other relevant information. It is strongly suggested that you communicate any problem to the Operator's base staff without delay and complete a report whilst at the base. If you fail to follow this simple procedure the Operator will have been deprived of the opportunity to investigate and rectify your complaint whilst you were on the charter and this may affect your rights under this contract. It is unlikely that you will have a complaint that cannot be settled amicably between you and the Operator. However disputes to do with this contract which cannot be settled amicably, may (if you wish) be referred to an independent Arbitrator agreed to by both parties. This will be done to ensure an outcome can be achieved with a minimum cost to both parties.

8. THE OPERATOR'S LIABILITY TO YOU
Other than as set out in these Booking Conditions or as implied by law, the Operator is not liable for any loss or damage suffered or incurred by any person in relation to the charter arrangements. To the extent that the Operator is liable and the Operator can limit their liability, the Operator's liability is limited to:
(a) in the case of goods, any one or more of the following:
(i) the replacement of the goods or the supply of equivalent goods;
(ii) the repair of the goods;
(iii) the payment of the cost of replacing the goods or of acquiring equivalent goods;
(iv) the payment of the cost of having the goods repaired;
OR
(b) in the case of services:
(i) the supplying of the services again; or
(ii) the payment of the cost of having the services supplied again.

9. EQUIPMENT AND YACHT INSURANCE COVER
The Operator's equipment and yachts are comprehensively insured. The Operator's policy provides full cover for the equipment and yachts and no less than $10,000,000 third party cover for your skipper and crew. However you may like to take out one- off public charter’ liability. The Operator is not responsible for any loss which you may suffer as a result of the insurers failing to indemnify any risk through your providing incorrect information on the booking form. You may choose to take out charterer’s liability cover for the period of your charter. A damage waiver payment must be paid at the time of your final balance to which should cover minor accidental damage to the charter yachts. The amount is determined by the size of yacht. A blank credit card imprint is also taken on arrival to the Operator's base. This is to cover against any loss of equipment or for any additional services or
goods you may require during your charter. However, should damage or loss be caused as a result of wilful
damage by a client, a client under the influence of alcohol or drugs or as a result of not obeying the Operator's staff instructions, then he or she will be liable for the full amount of repair or replacement. Adults will at all times be responsible for minors in their charge.

10. SAFETY
The Party Leader is responsible for assuring that he/she and the crew are competent to undertake the planned itinerary. The Party Leader must take note of safety information contained in any written material or delivered in the yacht and chart briefings and is responsible for briefing the crew on this, the yacht and its systems.

• The Party Leader is responsible for checking the inventory and yacht systems before the yacht makes passage.
• The Party Leader has primary responsibility for the safety and acts or omissions of the crew and craft at all times.
•Yachts may not be sailed single-handed and the second crew member should be fit and have at least a basic knowledge of yachts.
• As with other activity based holidays, watersports activities contain an element of risk. It should be understood that participation in these activities is your decision and at your risk.
• The Party Leader has primary responsibility for the safety of the crew and craft at all times.
• Neither night sailing nor partaking in any third party race is permitted without the Operator's prior written approval. In the interests of the safe conduct of your charter, the Operator and their staff may order a change to your itinerary, decide whether or not conditions are safe to use a craft or make a passage and whether this should be under power or sail. The Operator will not be liable in any way if
these changes are made. You must follow the instructions of the Operator's staff at all times.

11. WHAT IF MY YACHT IS NOT AVAILABLE?
Should your yacht not be available when you arrive through no fault of the supplier (e.g, having been damaged by a previous client) the supplier may substitute another yacht if necessary of a different type but of similar or larger dimensions and facilities. If a yacht is not available then accommodation will be provided for you free of charge in a hotel of the Operator's choice while repairs are carried out or an alternative yacht is provided. Should this happen you will be reimbursed under the supplier Guarantee. This paragraph 11 does not apply if the cause is a Force Majeure event (see paragraph 5).

12. BROCHURE ACCURACY
The Worldwide Sailing Holiday 07-08 brochure is prepared from information gathered prior to publication. Every care is taken to ensure that this information is still correct at the time of going to press (December 2007) but it has to be remembered that facilities may be withdrawn from the Operator and charter particulars altered as a result. These circumstances are regrettably beyond the Operator's control and the Operator is unable to accept liability if they occur. The Operator's sales staff are instructed to advise enquirers of amendments to the Worldwide Sailing Holiday 07-08 brochure which the Operator regard as significant. The Operator may make any modifications they feel appropriate to the routes, yachts and the equipment provided at any time, without prior notice. The Operator's sales staff are often asked for information not contained in the Worldwide Sailing Holiday 07-08 brochure. Whilst every effort is made to ensure that all information given is correct, the Operator cannot be held responsible if this should prove inaccurate, unless information is requested from the Operator and answered by the Operator, in writing.

13. DATA PROTECTION
The supplier will use your information to advise you of relevant special offers, product and charter change information. The Operator will also try to negotiate discounts and offers for you on appropriate third party products. Rest assured the Operator will not give these third parties access to your information without your prior consent, but will only allow them to communicate with you through the Operator with your permission. Please be aware that by signing the booking form you are consenting to the use of your information as described above. You may request access to your information and request that your details be corrected at any time. Experience Required for Yacht Charters in the Whitsundays
No official qualifications or licenses are required to charter a yacht or catamaran in the Whitsundays. However, the supplier does insist that at least one member of your party has sailing experience to Level 3-4.

Level 1:
Handling a yacht under motor, basic wind awareness, mooring and anchoring skills and/or flotilla course at the supplier Club or Sailing School.

Level 2:
Handling a yacht under sail, reefing, reading a chart, line of sight navigation, competent at bows to and stern to mooring.

Level 3:
As above plus previous skipper experience on flotilla holiday or equivalent experience. You will need to be competent of handling a yacht in close quarters and picking up a mooring buoy in varying conditions. Passages are longer with more varied conditions and stronger winds.

Level 4:
More taxing sailing areas where extended coastal experience is beneficial. RYA Day Skipper or equivalent experience, you should be able to...

* call on navigation and pilotage skills
* know your position at any one time

WHAT QUALIFICATIONS DO I NEED TO CHARTER?
Experience is more important than paper qualifications. Although no formal qualifications are required to charter your own bareboat yacht, the supplier Whitsundays does insist that at least one of your crew members has previous sailing or yachting experience.

2 people on board with sailing experience are required . The skipper must have sailed this size yacht before for at least 5 days or more, and have good navigation skills and must know how to anchor the yacht. The 2nd adult must have sailing knowledge and they need to know what to do in an emergency man over board

Upon booking you will be asked to fill out a sailing resume outlining your sailing history. If you do not have enough experience or are a complete novice, the supplier’s experienced instructors can get you to a level where you are confident enough to handle your own yacht.

HOW CAN I LEARN TO SAIL?
If you don't have any sailing experience but wish to experience a bareboat charter holiday, why not enrol in one of the supplier's Sailing School courses, which can have you sailing your own yacht in no time!

DO I NEED A PROFESSIONAL SKIPPER?
Of course you don't need to hire a skipper for your holiday, but choosing a crew to accompany you on your the supplier yacht charter holiday means you can sit back and totally relax.

The Operator's crew are chosen for their friendliness and professionalism, and are dedicated to making your holiday as enjoyable and relaxing as possible.

Book a skipper and hostess for a crewed yacht charter of complete indulgence, or create your own culinary delights and just have a skipper taking the helm of your the supplier yacht so you can sit back and enjoy.

HOW SAFE IS BAREBOAT YACHTING?
To ensure your safety at all times during your sailing holiday, the supplier is contactable 24 hours a day, seven days per week via VHF marine radio. the supplier’s radio announcements ("scheds") are also run twice daily to inform you of the latest weather forecast and record each yacht’s daily movements and overnight anchorages. The supplier Whitsundays has a reliable back-up service ensuring you will not be alone in the unlikely event of an emergency, or if you simply need more supplies or provisions.

WHAT ARE THE OPERATING HOURS?
Base operating hours are 7.30am - 5pm with 24 hour emergency phone numbers provided on arrival. The Operator is open every day of the year however will not except charter bookings to start on Christmas Day.

WHAT TIME DO I START MY YACHT CHARTER?
Contract start time is 12 noon on the first day of your sailing holiday, providing the Operator with enough time to fully prepare your yacht. If you are already at the supplier Whitsundays base or wish to start your charter earlier, the Operator will endeavour to meet your requests. The Operator can advise you of a briefing time at 8.30am on the day your charter commences.

Contract finish time on your last day is 10.00am. Late check-outs are available depending upon your vessel’s movements the following day. Late check-outs cannot be confirmed until the day before you finish your yacht charter. Again, the Operator will always endeavour to accommodate all special requests.

WHAT DOES IT COST? ARE THERE ANY OTHER FEES?
You’ll be amazed at just how affordable it is to charter your own luxury yacht for the sailing holiday of a lifetime. As a general guide, a yacht charter usually equates to approximately $100 per person per night, depending on the size of vessel, number of people and length of stay.

SHOULD I TAKE OUT TRAVEL INSURANCE?
The supplier strongly recommends you cover your prepaid yacht charter fees against cancellation due to circumstances beyond your control. The Operator's Reservations Team can supply you with information on insurance policies available.

WHAT ABOUT FOOD AND BEVERAGES?
Careful provisioning is an important part of the preparation for your sailing holiday. By pre-arranging your provisioning with the Operator, your vessel will be fully stocked with the type of catering you require prior to your arrival. Should you prefer to order specific provisions but wish the Operator to do your leg work, the Operator's Self Select list has been prepared for your convenience. Sailing can be very thirsty work. The Operator can stock your yacht with a range of beer, wine, spirits and cold drinks so you will never run dry!

WHAT SHOULD I BRING?
Not very much! Each the supplier yacht is fully equipped for charter from every imaginable viewpoint. Apart from your personal possessions, you should bring your own...
* beach towels
* sunscreen
* swimwear
* polarised sunglasses (essential for seeing fringing reefs and can be purchased from the supplier on arrival)
* footwear – good solid footwear is advisable (an old pair of sneakers are ideal)
* broad brimmed hat
* light clothing that will provide protection from the sun and a tracksuit or warm clothing for the evenings
* Soft luggage where possible

The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vessel. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking, you must complete our no-obligations reservations enquiry form which is easy to follow and secured with the latest encryption technology. Once we receive your enquiry, we will contact you via phone or email, to advise of availability and confirm the final price is correct - and discuss payment options. A booking is confirmed when you have been emailed a confirmation notice and at this stage the deposit is processed on your credit card and becomes non-refundable and any cancellation fees stated in the terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

Please note we accept Visa and Mastercard and the credit card fees are: 
1) 1.75% for the deposit amount.
2) 1.75% for the balance of payment.

If you are booking via phone, please first make sure you have read the terms and conditions of your selected sailing adventure. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental, trip or charter services.

Amendments
Please check the terms of each vessel to see whether amendment fees apply. Please also note that for some vessels an amendment is treated as a new booking and the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). In the case of boat rental/yacht charter, if the hire or number of days is increased, an additional deposit may be required, while reduction in rental periods or price may reduce the total, but the deposit amount will remain unchanged.

Vessel Capacity and fitness to charter (for Bareboats only)
Under no circumstances are you permitted to carry more passengers than the vessel you charter is legally registered to carry, and if you do your insurance may be invalidated. The number of passengers allowed is indicated next to each vessel on this website. It is your responsibility to choose a journey that is within your capabilities. A boat or trip supplier can refuse to hire a vessel to any person who is in their opinion unfit to skipper or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

THE OPERATOR'S LIABILITY TO YOU

Other than as set out in these Booking Conditions or as implied by law, we are not liable for any loss or damage suffered or incurred by any person in relation to the holiday arrangements. In addition, we are not responsible or liable for loss, damage or theft of personal luggage and belongings. Please check with your insurance agent prior to departure to make sure you are adequately covered for any eventualities.

EQUIPMENT AND YACHT INSURANCE COVER
Equipment and yachts are comprehensively insured. The Operator'spolicy provides full cover for the equipment and yachts and no less than $10,000,000 third party cover for your skipper and crew. However you may like to take out one- off public charter’ liability. The Operatorare not responsible for any loss which you may suffer as a result of the insurers failing to indemnify any risk through your providing incorrect information on the booking form. You may choose to take out charterer’s liability cover for the period of your charter.

 
Damage Waiver
A damage waiver payment must be paid at the time of your final balance to which should cover minor accidental damage to the charter yachts. With the payment of a daily rate, you can limit your financial responsibility in a case where the yacht or its equipment sustains some type of loss or damage. The daily rate is determined by the size of the yacht. The daily rate is paid at the time your final balance is paid. The excess will be covered when the Operator obtains a blank credit card imprint upon your arrival at their base.

If a loss or damage occurs at a value lower than your applicable excess, then only the amount of such loss or damage will be charged to your card. If the loss or damage incurred exceeds your applicable excess, then your credit card will be charged in the amount of the applicable excess. If no loss or damage occurs, your card will not be charged. However, the yacht damage waiver does not cover acts of gross negligence, such as loss or damage sustained whilst sailing outside the defined sailing area or hours, sailing under the influence of alcohol or drugs, running aground, or taking the yacht single-handed as stated in the Operator's Booking Conditions. Where the yacht damage waiver does not provide coverage, you will become financially responsible for the entire loss or damage.

SAFETY
The Party Leader is responsible for assuring that he/she and the crew are competent to undertake the planned itinerary. The Party Leader must take note of safety information contained in any written material or delivered in the yacht and chart briefings and is responsible for briefing the crew on this, the yacht and its systems.
• The Party Leader is responsible for checking the inventory and yacht systems before the yacht makes passage.
• The Party Leader has primary responsibility for the safety and acts or omissions of the crew and craft at all times.
•Yachts may not be sailed single-handed and the second crew member should be fit and have at least a basic knowledge of yachts.
• As with other activity based holidays, watersports activities contain an element of risk. It should be understood that participation in these activities is your decision and at your risk.
• The Party Leader has primary responsibility for the safety of the crew and craft at all times.
• Neither night sailing nor partaking in any third party race is permitted without the Operator'sprior written approval.

In the interests of the safe conduct of your charter, the Operatorand their staff may order a change to your itinerary, decide whether or not conditions are safe to use a craft or make a passage and whether this should be under power or sail. The Operatorwill not be liable in any way if these changes are made. You must follow the instructions of the Operator'sstaff at all times.
Adults will at all times be responsible for minors in their charge.
